Vacation Rental Policies

The Guest agrees to the following terms for the use of the Accommodations between the Check-In and Check-Out Dates:

Payment Terms:
50% of rental amount due upon reserving property, and balance due 30 days prior to arrival.

Check-In/Check-Out:
The Accommodations will be available for occupancy beginning at 4:00pm on the Check-In Date, and must be vacated by 11:00am on the Check-Out Date. A fee equal to 100% of one nights stay will be charged if unit is not vacated by above specified time. All doors and windows must be locked. Should the guest not properly lock or alarm the property, they may be responsible for damages.

Rental Usage:
Guest understands that they are gaining usage of the property only through a license to use and is not gaining any interest in the property. Guest expressly acknowledges and agrees that this agreement is for transient occupancy of the property, and that guests do not intend to make the property a residence or household. The Guest shall not sublet the property.

Location/Maximum Occupancy:
The location and description of the Accommodations are shown at the top of this Agreement. The Guest will permit no more than the Maximum Occupancy listed. The Guest agrees to pay $20 per night for each additional occupant up to the maximum allowable occupancy for the specific property.

House Rules:
The guest shall conduct themselves in a civilized manner, respecting the rights of the surrounding guests and property owners. The guests shall not create unreasonable noise or disturbances. The guests shall pay for any damage to the premises over and above normal wear and tear. Manager has the right to inspect the premises without further notice at any time to enforce the terms of this agreement. Should the guests violate any of the terms of this agreement, the rental period can be terminated immediately.

Reservation Cancellation Policy:
If the guest cancels the occupancy more than 60 days before the commencement of the term of occupancy, the rental deposit will be refunded, less a handling fee in an amount equal to ten percent (10%) of the rent due under the short term rental agreement, plus New Mexico Gross Receipt Tax. All other fees paid under this agreement will be refunded. If the guest cancels the occupancy 60 or fewer days before the commencement of the term of occupancy, the guest shall receive a refund only if DNM is able to find a substitute occupant for the term of occupancy that will pay the same rental amount. If a substitute occupant is found, all sums paid by the tenant shall be refunded to the tenant, less 25% of the rent due under the short- term rental agreement, plus New Mexico Gross Receipt Tax. If a substitute occupant is not found, there will be no refund of any sums paid to the guest(s).

Repairs and Maintenance:
Guest understands that the Manager may enter the unit to affect necessary repairs. Manager reserves the right to move the guest if needed repairs cannot be accomplished in a timely manner.

Trash Removal:
The Guest agrees to deposit accumulated household trash in either the compound trash containers located on site or a trash container for a home in or outside the garage.

Phones:
A long distance block may be activated that will require guests to use a credit card or long distance calling card to have long distance telephone service. Should a guest charge long distance telephone calls to the phone in the property, the guest(s) agrees to be responsible for long distance charges incurred during the guest's occupancy. The guest agrees that any long distance charges incurred during the term of the guest's occupancy and appearing on the owner's telephone bill may be included as a charge upon the guest's credit card.

Internet Access:
Our homes have various types of Internet access provided by various third parties. Neither Manager nor Owner is responsible for data loss, theft, loss of Internet access or connection, or inability of the Guest to connect to the Internet.

Smoking Policy:
All of the properties are non-smoking. Smoking will result in a $500 additional charge.

Pet Policy:
Your agent will designate which properties will allow pets. All arrangements for including a pet in the stay will need to be made at the time of the booking. If there is damage caused by the pet, the guest shall be responsible and any additional costs to repair damage shall be deducted from the guests' deposit or charged to the credit card provided.

Property Condition / Cleaning:
Guests are expected to maintain the property in reasonable condition during their stay. Guests assume liability for any loss or breakage of the contents of the property. If there is a breakage or damage to the appliances, furnishings, or the property itself, the Guest is responsible for reporting such findings to the Manager as soon as possible. The guest understands that the Manager reserves the right to charge an additional cleaning fee on guest's credit card if the condition of the property upon the expiration of the term of occupancy so requires. If the term of occupancy exceeds 30 days, guest shall allow the property to be cleaned additional times during the term of occupancy and shall pay for such additional cleanings. All house- cleaning of the property shall be by cleaners employed by the Owner or by the Manager.

Injury:
The guests shall hereby indemnify and hold harmless the Owner, Manager and their employees against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss, which the Manager may maintain on the property, does not cover the personal property of guests, and that guests should purchase their own insurance if such coverage is desired.

Disputes:
The law of the State of New Mexico shall govern all controversies and disputes between the parties. All controversies or disputes shall reside in Santa Fe County, and/or Taos County New Mexico regardless of where the rental agreement was signed. Guests shall be responsible for any attorney’s fees and other expenses incurred by the Manager or Owner should Guest breach this agreement.

Insurance:
Owner's insurance does not cover loss or damage to guest's personal possessions and guest shall bear the risk of loss of all guest's property. The property Owner or Manager are not responsible for personal injury.
